How to Obtain a US Work Visa

Applying for a US work visa is a multi-step process that requires filing several forms, providing evidence of your qualifications to work in the US, and attending an interview. There are many websites that offer work visa services for a fee, however, all of the forms and instructions are available for free from the US government. Here are guidelines to help you find the forms and fill them out correctly.

First, visit the US State Department website page http://travel.state.gov/visa/temp/types/types_1286.html to see the types of temporary US visas available. Then visit http://travel.state.gov/visa/temp/types/types_1271.html to see the types of temporary worker visas available. Read the information to determine which visa category you are in.

The person applying for a US work visa must fill out forms DS-156 and DS-157. These are available to download for free from the Department of State website. You need to submit supporting documents and evidence with these forms, and the forms include directions on how to do this. All fees are paid by check when you mail your completed application.

The prospective employer must file form I-129 on behalf of the worker. This form is available on the USCIS website at http://www.uscis.gov. It is much easier to apply for a US work visa if you already have a job set, or if you are already living in the US under another type of visa. If you reside overseas and do not have a job lined up in the US, it is much more difficult to obtain a US work visa.

Keep in mind, these are only the basic forms that prospective workers and their employers must file. Depending on other factors, such as bringing family, there may be additional paperwork. Call the Dept. of State or the USCIS if you need clarification.

Be wary of immigration services websites that are not affiliated with the US government. To avoid scams and to ensure that you get the most accurate information, make sure the website ends in .gov.
